ACCEPTANCE OF TERMS By creating an account, accessing, or using the DataUnfold platform (the &#8220;Service&#8221;), you (&#8220;User&#8221; or &#8220;Customer&#8221;) acknowledge and accept these terms. The Service is operated by DataUnfold (9534-9437 Qu\u00e9bec Inc.), located in Quebec, Canada (&#8220;DataUnfold&#8221;).<\/li>\n\n\n\n<li>2. PLATFORM &amp; MODEL OPTIONS The Service provides access to various AI models through a single DataUnfold account. DataUnfold acts as a technical and contractual intermediary so Users do not need to create, manage, or pay for separate accounts with multiple AI providers.<\/li>\n\n\n\n<li>2.1 Centralized access The Service centralizes access to AI capabilities via the platform interface and a single account.<\/li>\n\n\n\n<li>2.2 Model selection For each processing request, Users may select the execution engine from options offered by the Platform: Option A \u2014 DataUnfold&#8217;s proprietary model (hosted and managed by DataUnfold); Option B \u2014 Partner models (third\u2011party providers such as Microsoft, Google, AWS) integrated and secured by DataUnfold.<\/li>\n\n\n\n<li>2.3 Features Regardless of the chosen model, the Service may include, without limitation: analysis, structuring and organization of unstructured data; extraction of information from documents, images or emails; automation of workflows.<\/li>\n\n\n\n<li>3. NATURE AND LIMITS OF AI 3.1 Decision\u2011support only Outputs produced by AI models (including the DataUnfold AI Endpoint) are automated, probabilistic analyses provided as decision\u2011support and do not constitute professional advice or guaranteed accurate results. 3.2 Validation responsibility Users remain fully responsible for verifying outputs, their interpretation, and any decisions made based on those outputs.<\/li>\n\n\n\n<li>4. ACCOUNT AND SECURITY Users are responsible for keeping their credentials confidential. Any actions performed via the account are deemed to have been taken by the User.<\/li>\n\n\n\n<li>5. USER DATA OWNERSHIP Users retain all intellectual property rights in the data, files and content they submit to the Platform (&#8220;User Data&#8221;). No ownership rights are transferred to DataUnfold.<\/li>\n\n\n\n<li>6. DATA PROCESSING &amp; PRIVACY 6.1 Strict no\u2011training policy User Data sent to the DataUnfold AI Endpoint: will never be used to train, fine\u2011tune or improve DataUnfold&#8217;s AI models; will never be reused for statistical or commercial purposes outside the customer&#8217;s account; will never be shared with third parties for training. Data use is strictly limited to executing the User&#8217;s requested operation.<\/li>\n\n\n\n<li>6.2 Retention &amp; deletion User Data may be retained temporarily for a maximum of sixty (60) days for operational purposes (system functioning, technical logs, debugging). After that period, data are permanently and irreversibly deleted.<\/li>\n\n\n\n<li>7. USER RESPONSIBILITY Users represent and warrant they have the rights required to submit User Data and that such data comply with applicable laws (including Quebec&#8217;s Law 25). DataUnfold acts solely as a technical provider and does not perform legal review of content.<\/li>\n\n\n\n<li>8. DATAUNFOLD INTELLECTUAL PROPERTY The DataUnfold application, source code and the DataUnfold AI Endpoint (proprietary models and algorithms) remain the exclusive property of DataUnfold. No right to reverse\u2011engineer is granted to Users.<\/li>\n\n\n\n<li>9. AVAILABILITY &amp; LIMITATION OF LIABILITY The Service is provided &#8220;as is&#8221; without warranty of uninterrupted availability. To the maximum extent permitted by law, DataUnfold&#8217;s total liability is limited to direct damages and shall not exceed the amount paid by the User in the twelve (12) months preceding the claim. DataUnfold is not liable for indirect losses.<\/li>\n\n\n\n<li>10. CHANGES TO THE TERMS DataUnfold may modify these terms. Changes take effect upon publication on the Platform.<\/li>\n\n\n\n<li>11. INDEMNIFICATION The User agrees to defend, indemnify and hold DataUnfold (its officers, employees and partners) harmless from any claim, loss, damage or expense (including reasonable legal fees) arising from: the User&#8217;s breach of these terms; illegal use of the Service or generated data; infringement of any third\u2011party rights by data submitted by the User.<\/li>\n\n\n\n<li>12. GOVERNING LAW These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada.
